General Policy

This document contains FINSTRAL AG's privacy policy concerning the protection of personal data and aims at an accurate description of how personal data of users is treated and processed when they visit our website.

Furthermore, the following information adapts Art.13 of the Legislative Decree No.196, 30 June 2003, and is intended for users of services that we offer on our website and may be accessed online.

Information stated here is not valid for other websites which may be accessed via links provided on our site. FINSTRAL AG does not hold liability of any kind for those websites.

The following statements are based on Recommendation No.2/2001 of the European Data Protection Supervisor for the protection of personal data, which has been adopted on 17 May 2007 in accordance with Art.29 of the Directive No.95/46/EG, and in particular concerns the treatment of personal information in the world wide web. The statements aim at introducing minimum measures that need to be taken towards affected individuals and thus to guarantee the equity and legitimacy of such practices (thus applying art.6, 7, 10, 11 of Directive 95/46/EG).

The "proprietor" of processed data

"Proprietor" of personal data that might be processed when using our website and of any other information used for the performance of our services is FINSTRAL AG, Gastererweg 1, 39054 Unterinn/Ritten (BZ), ITALY.

System administrator

In compliance with Articles 33 et seq. and 154, Section 1, paragraphs c) and h) and respectively with the regulations of the minimum technical safety measures as stated in Enclosure B, and according to the mandatory measures and precautions concerning data processing via electronic means of 27 November 2008 (G.U. [Official Gazette of the Italian Government] No. 300 published on 24 December 2008), and to the terms of agreement, the person responsible for our computer centre was appointed as system administrator.

Rights of data subjects

According to art.7, Legislative Decree 196/2003, affected individuals, who have submitted personal data, hold the right at all times to receive confirmation on the availability or non-availability of such data, to receive information on their content and origin, to examine their compliance with actual conditions or to demand that data be supplemented, updated or changed.

These affected individuals furthermore have the right to demand the deletion, the conversion to an anonymous form, or the blocking of unlawfully processed data, as well as, on justified grounds, to object to their processing.

All requests concerning Art.7 of the Legislative Decree No.196/2003 are to be mailed to FINSTRAL AG, Gastererweg 1, 39054 Unterinn/Ritten (BZ), ITALY, or e-mailed to finstral@finstral.com.

Location and purpose of data processing

The processing of data linked to web services offered on these sites [physically hosted at Brennercom AG (www.brennercom.it) in Italy] is object of FINSTRAL AG headquarters and exclusively carried out by appointed employees or associates of FINSTRAL AG, or individuals hired for occasional maintenance work.

Information collected from web services will not be circulated.

Data provided by users and personal information submitted for service requests are used solely for the provision and performance of the services demanded. They will not be communicated to third parties, given that such transmission, as for instance to our authorized partners, is not part of the requested service, nor obligatory by law, nor absolutely necessary for the performance of such services.

Specific purposes regarding the various processing modes are explicitly marked on the respective sites of the distinctive services.

Visitors will find specific information concerning the use of personal data in terms of art.13, legislative decree 196/2003, on the individual sites.

This information however, relies on the principals of the company's privacy policy.

Voluntary provision of data

Apart from statements concerning navigational data, users may decide whether or not to supply personal data when requesting informational material or any other services offered by our company.

However, if data is not provided, users could fail to receive the demanded service.

Typology of processed data

Navigational data

The Software procedures necessary for the functioning of this website capture certain personal data during their regular operations. Transmission of this information occurs exclusively for the internet communication protocol.

This information is not recorded to associate it with identified individuals, but could allow, due to its nature, an identification of users, by processing and linking it with data held by third parties.

Such data are: IP-addresses, domain-names of computers used to connect to the website, URI-addresses of requested resources, the time when the request was made, the method used to submit a request to the server, the size of files obtained in replies, the numeric code marking the status of server replies (error, successful etc.) and other parameters referring to the operating system and the computer set-up of the user.

These data are collected solely for anonymous statistical information during the use of this website and for the examination of the correct functioning of the same. They will be immediately erased after being processed.

The data in question may be used to ascertain liability in case of possible offences with damages to our website. Apart from such a scenario, data are generally saved no longer than 7 days.

Data provided voluntarily by users

The optional, explicit and voluntary sending of emails to addresses stated on this website results in the acquisition of the sender's address as well as some personal data contained in the e-mail, which is necessary for furnishing replies.

Specific brief and/or complete information is contained on the pages of this website which refer to special services at request.

We kindly ask our visitors to refrain from mentioning names or personal data of third parties in their service requests or inquiries, unless absolutely necessary. Essentially more advisable would be the use of fictional names.

Modalities of data processing

Personal data will be saved as a print-out and/or via automated tools for the period of time necessary to achieve the aims for which they have been collected.

We follow particular security measures in order to prevent loss of data, illegitimate or improper use, or unauthorized access.
